ARBITRATION AND DISPUTE RESOLUTION
This book, “Arbitration And Dispute Resolution in Nigeria: Practice And Procedure’’ was written from the vast experience of the author as a teacher and practitioner of Alternative Dispute Resolution in Nigeria.
Disputes have become an inevitable part of society. The old methods devised to resolve these disputes, especially litigation, have been found not suitable for certain disputes, apart from their adversarial or combative nature. This had given rise to alternative methods, generally referred to as Alternative Dispute Resolution (ADR) mechanisms. These ADR mechanisms include but are not limited to Negotiation, Conciliation, Mediation, Arbitration, Early Neutral Evaluation (ENE), Ombudsman, Online Dispute Resolution (ODR) and the Multi-Door Court (MDC).
The central theme of this book is the practice and procedures involved in the utilization of these ADR mechanisms in the resolution of civil disputes, particularly commercial disputes. In pursuance to these objectives, the book is divided into nineteen chapters dealing with specific sub-themes.
Chapter 1 deals with the Introduction: covering the nature of disputes and how they arise, as well as the definition of basic terms and concepts.
Chapters 2-13 deal with Arbitration generally even though specific subject areas have
to be assigned to each of these chapters viz:
Chapter 2 – Basic Principles and Laws/Rules Governing Arbitration Practice in
Nigeria.
Chapter 3 – The Nature and Scope of Arbitration. Chapter 4 – Types and Forms of Arbitration. Chapter 5 – Arbitration Agreement.
Chapter 6 – Commencement of Arbitral Proceedings. Chapter 7 – Constitution of Arbitral Tribunal.
Chapter 8 – Duties, Powers and Immunity of an Arbitrator. Chapter 9 – Arbitral Proceedings.
Chapter 10 – Arbitral Award.
Chapter 11 – Recourse against Award.
Chapter 12 – Recognition and Enforcement of Award. Chapter 13 – Fees and Cost of Arbitration.
Chapter 14 – Deals with the role of the Court, the Ministry of Justice and Counsel in
Arbitration.
Chapter 15 – Discusses the Processes and Procedures in Negotiation.
Chapter 16 – Deals with the Practice and Procedures in Conciliation and Mediation. Chapter 17 – This chapter examines the Multi-Door Courthouse System, its Origin,
Evolution, and general Practice and Procedures.
Chapter 18 – Discusses the problems associated with Arbitration and ADR Practice and Development in Nigeria.
Chapter 19 – is the concluding part of the book, which is essentially a summary of all
the chapters, in addition to the strong conviction expressed that Nigeria is well endowed with resources and potentials to promote the practice, growth and development of arbitration and could be a preferred destination for the practice of arbitration and ADR, provided the needful is done.
